SMS TERMS AND CONDITIONS
Text Message Communications Policy

These SMS Terms and Conditions govern all text message communications sent by this coaching business, registered in Tucson, Arizona, United States. They apply to two distinct types of SMS programs: (1) client session communications, and (2) marketing and subscription SMS messages, including the Animal Medicine Card weekly subscription. These terms comply with the Telephone Consumer Protection Act (TCPA), Federal Communications Commission (FCC) regulations as updated through 2026, and CTIA Messaging Principles and Best Practices.
By providing your mobile phone number and opting in to receive text messages from us, you agree to these SMS Terms and Conditions in full.

1. TWO SEPARATE SMS PROGRAMS
This business operates two distinct SMS programs. Consent to one does not constitute consent to the other. You may opt in or out of each independently.
Program A — Client Session Communications
Transactional and administrative text messages related to your active coaching engagement. This includes session reminders, scheduling updates, rescheduling notifications, follow-up administrative messages, and brief between-session communications as outlined in the Coaching Terms and Conditions. Message frequency varies based on your session schedule, typically 2–4 messages per month.
Program B — Marketing and Subscription SMS (Animal Medicine Card Weekly Subscription and General Marketing)
Promotional and subscription content including your weekly Animal Medicine Card pull, special offerings, new program announcements, and other marketing communications. Message frequency is approximately 4–8 messages per month, including one weekly subscription message and occasional additional marketing messages.
2. CONSENT AND OPT-IN REQUIREMENTS
Under the TCPA and FCC rules effective January 2026, prior express written consent is required before any marketing or promotional text message is sent to you. This consent must be obtained separately for each program listed above and cannot be shared, sold, or transferred to any third party.
You may provide consent to receive SMS messages in any of the following ways:
Checking an SMS opt-in checkbox on a website form, booking page, or subscription sign-up
Replying YES or a designated keyword to an initial opt-in text message
Submitting a written request by email or contact form to receive SMS communications
Providing your mobile number and explicit verbal or written consent during a coaching intake process, confirmed in writing
Pre-checked boxes do not constitute valid consent under TCPA. Your consent must be an affirmative, deliberate action. You will never be enrolled in SMS communications without taking an active opt-in step.
Consent to receive text messages is never a condition of purchasing coaching services or any subscription. You may use all coaching services and purchase any product or subscription without consenting to SMS communications.
3. WHAT MESSAGES YOU WILL RECEIVE
Program A — Client Session Communications may include:
Session confirmation and reminder messages
Rescheduling notifications and confirmations
Brief administrative follow-ups directly related to your coaching sessions
Overage invoice notifications (as outlined in your Coaching Terms and Conditions)
Program B — Marketing and Subscription SMS may include:
Your weekly Animal Medicine Card pull message or notification
Announcements of new programs, offerings, or availability
Seasonal or special promotional messages
Subscription renewal reminders
We will never send messages that contain sexual content, hate speech, content related to alcohol, firearms, or tobacco, or any content that violates CTIA SHAFT content guidelines. All messages will be relevant to coaching services, spiritual and personal development content, or your active subscription.
4. HOW TO OPT OUT
You may opt out of either or both SMS programs at any time using any of the following methods, all of which are honored under FCC rules effective April 2025:
Reply STOP to any text message to opt out of that program immediately
Reply QUIT, CANCEL, UNSUBSCRIBE, END, or REVOKE — all are recognized opt-out keywords
Send an email to info@lizcaraballo.com requesting removal from SMS communications
Make a verbal request during a coaching session, confirmed in writing
Submit a request through the website contact form
All opt-out requests will be processed within 10 business days, though we aim to process them immediately. You will receive one final confirmation message within 5 minutes of your opt-out request, with no promotional content, confirming which program(s) you have been removed from. No further messages will be sent after that confirmation.
If you opt out of Program B (marketing and subscription SMS), your Animal Medicine Card weekly subscription will be paused for SMS delivery. You may still receive subscription content via email if you remain on the email list. Please contact us if you wish to manage your subscription delivery method separately.
Opting out of Program A (client session communications) means you will no longer receive session reminders or administrative texts. You remain responsible for attending scheduled sessions and managing your calendar independently.
5. HOW TO GET HELP
Text HELP at any time to receive a return message with the name of the SMS program, contact information, and a link to these SMS Terms and Conditions.

6. MESSAGE AND DATA RATES
Standard message and data rates may apply to all text messages you receive from us, depending on your mobile carrier and plan. This business does not charge any additional fees for SMS communications beyond your standard carrier rates.
You are responsible for any charges applied by your mobile carrier for sending or receiving text messages, including international messaging charges if you are located outside the United States. International clients should be aware that carrier charges for receiving US-originated SMS messages may vary significantly.
7. TIME OF DAY RESTRICTIONS
In compliance with TCPA regulations, we will not send marketing or promotional text messages before 8:00 AM or after 9:00 PM in your local time zone. All messages are scheduled with this restriction in mind.
Because this coaching practice serves clients globally, we make every effort to schedule messages during reasonable hours for the majority of our client base. If you are in a time zone where our messages arrive at inconvenient hours, please contact us at info@lizcaraballo.com and we will make reasonable accommodations.
Transactional messages (Program A) may occasionally be sent outside these hours in the event of an urgent scheduling change or session cancellation, as these are not classified as marketing communications under TCPA.
8. CONSENT RECORDS AND DOCUMENTATION
In compliance with TCPA requirements and as a best practice, we maintain records of all SMS consent including the date and method of opt-in, the phone number provided, and the program consented to. These records are retained for a minimum of 5 years.
We will never send marketing text messages to numbers obtained through lead lists, purchased databases, or any source where explicit individual consent was not obtained directly from you. Each person in our SMS program has individually and directly consented to receive messages from this business specifically.
As of January 2026, under updated FCC one-to-one consent rules, consent obtained through this business cannot be shared with or applied to any other sender or business entity.
9. MAILCHIMP AND EMAIL INTEGRATION
This business uses Mailchimp, operated from Tucson, Arizona, as its primary email marketing platform. SMS communications and email marketing are managed as separate programs. Opting in to email communications through Mailchimp does not constitute consent to receive SMS messages, and vice versa.
If you subscribe to the Animal Medicine Card weekly content, you may choose to receive it via email (through Mailchimp), via SMS (through this SMS program), or both. These are independent opt-ins and you may manage them separately at any time.

10. SUPPORTED CARRIERS
SMS messages from this business are supported by all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and their affiliated networks. Carrier support is not guaranteed for all international mobile networks.
This business is not liable for delays or failures in message delivery caused by your mobile carrier, network outages, or technical issues outside our control.
11. CHANGES TO THESE SMS TERMS
We reserve the right to update these SMS Terms and Conditions at any time. If we make material changes — particularly to the types of messages sent, message frequency, or opt-out procedures — we will notify active SMS subscribers via text message before the changes take effect.
The “Last Updated” date at the top of this page reflects the most recent revision. Continued receipt of SMS messages after notification of changes constitutes your acceptance of the updated terms. You may opt out at any time if you do not agree to updated terms.
12. GOVERNING LAW
These SMS Terms and Conditions are governed by the laws of the State of Arizona, United States, and applicable federal law including the Telephone Consumer Protection Act (47 U.S.C. § 227) and FCC regulations. Any disputes arising from SMS communications shall be subject to the exclusive jurisdiction of the courts of Arizona.
